1. Preamble
These General Terms and Conditions of Sale (hereinafter referred to as "T&Cs") are offered by the company Damoni (hereinafter referred to as the "Company"), a Société à Responsabilité Limitée (SARL) with a capital of 1,000 euros, registered with the "Registre du commerce et des sociétés" of Limoges, France, under number 982 444 580, whose registered office is located at 3 chemin de la Font - 87510 Saint-Jouvent - France.
2. Purpose
These T&Cs define the conditions and terms under which the Service Provider makes the IzyPet application available to the Client, enabling pet care professionals to benefit from an online booking system, offer their clients access to booking services, centralize and manage all of their reservations efficiently, as well as facilitate two-way communication between pet care professionals and their clients.
3. Access to the Service
The Service is accessible online via the URL https://www.izypet.co/en. The Client agrees to use the Service in compliance with these T&Cs and applicable laws. Access to the Service requires an Internet connection, the cost of which is borne by the Client.
4. Registration and Account
To use the Service, the Client must create an account by providing accurate and complete information. The Client is responsible for the confidentiality of their login credentials and for all actions carried out through their account.
5. Pricing
The Service is offered as a monthly or annual Subscription. Commercial discounts for annual Subscriptions may be offered at a reduced rate compared to monthly Subscriptions. The rates are indicated on the IzyPet website and may be modified at any time. Price changes will be notified to the Client at least 30 days before they take effect.
6. Payment
Payment is made by credit card via a secure payment platform. Subscriptions are billed automatically unless terminated in advance by the Client.
7. Duration and Termination
IzyPet may offer a free trial period, which will be indicated on the website when the Client registers. At the end of this free trial period, if the Client has not chosen to subscribe, their account will be automatically closed.
The contract is concluded for the duration of the selected Subscription (monthly or annual). The Client may cancel their Subscription at any time from their customer area. The cancellation will take effect at the end of the current period.
8. Right of Withdrawal
In accordance with the applicable French rules on distance selling, the Client may cancel their Subscription by email or by letter addressed to the Company at the following address: Damoni, 3 chemin de la Font - 87510 Saint-Jouvent - France, within a withdrawal period of fourteen (14) days from the Subscription date. The contract will end on the date the withdrawal letter is received, and any fees already paid will be refunded.
9. Liability
The Service Provider undertakes to provide the Service in accordance with industry standards but cannot be held liable for Service interruptions, data loss, or indirect damages suffered by the Client.
The Service Provider acts as an intermediary between pet care professionals and their clients. The Service Provider cannot be held responsible for:
- Damage caused by pets to the Client or to third parties.
- Disputes arising between the Client and their clients.
- The inaccuracy of information provided by pet care professionals on the website or mobile application.
10. Automatic Contract Generation and Electronic Signature
IzyPet offers a service for automatically generating contracts that includes a simple electronic signature feature. This service is designed to simplify administrative processes for users.
Please note that simple electronic signatures, while legally recognized, do not provide the same level of security and reliability as advanced or qualified electronic signatures. Therefore, it is the user’s responsibility to ensure that the provided level of electronic signature meets their specific needs and legal requirements.
Users also have the option to print the contracts generated through the platform for handwritten signatures if required or preferred in their specific context.
IzyPet disclaims any liability in case of disputes or legal non-compliance resulting from the use of this feature. Users are encouraged to consult a legal advisor for any questions regarding the validity of the generated contracts or the electronic signatures used.
11. Invoicing Functionality
11.1 Purpose of the Invoicing Functionality
IzyPet provides an invoicing functionality (hereinafter referred to as the “Invoicing Functionality”), enabling pet care professionals to generate and manage invoices for their own clients directly on the platform. This feature is intended to facilitate the monitoring and automation of administrative processes for users.
11.2 Use and Responsibility of the User

The User acknowledges that they are solely responsible for verifying the legal and tax compliance of the invoices generated.

The User remains fully responsible for accounting and tax obligations related to the issuance of their invoices (including, but not limited to, the declaration and payment of VAT, professional taxes, etc.).

The User agrees to provide accurate and complete information regarding their identity, VAT number (if applicable), address, and any other data necessary for issuing invoices in compliance with the relevant regulations.
11.3 Limitation of the Service Provider’s Liability

The Service Provider provides the Invoicing Functionality “as is” and cannot be held liable for any calculation or input errors, nor for the content of the information entered by the User when generating invoices.

The Service Provider does not provide tax or accounting advice. It is the User’s responsibility to ensure compliance with all applicable regulations regarding invoicing operations and to consult a qualified professional (accountant, tax advisor, etc.) if necessary.

The Service Provider does not guarantee that the Invoicing Functionality meets all legal and regulatory requirements applicable to the User. The User is solely responsible for ensuring that the feature meets their own needs and legal obligations.
11.4 Availability and Updates

The Service Provider strives to ensure the availability and proper functioning of the Invoicing Functionality but does not guarantee continuous and uninterrupted access.

The Service Provider reserves the right to update, modify, suspend, or discontinue the Invoicing Functionality at any time, particularly for maintenance, updates, or business reasons. The Service Provider will make its best efforts to inform the User of any substantial change affecting the Invoicing Functionality.
11.5 Document Retention

It is the User’s responsibility to securely store their invoices and associated documents, in compliance with the retention periods required by applicable laws.

The Service Provider does not assume any legal or tax document retention obligations on behalf of the User, beyond making these documents available on the platform in the normal course of service.
12. Intellectual Property
The Service Provider retains full intellectual property rights over the Service, including software, interfaces, and associated content. The Client is granted a personal, non-exclusive, and non-transferable right to use the Service.
13. Personal Data
Personal data collected during the use of the Service is processed in accordance with applicable regulations, including the General Data Protection Regulation (GDPR). The Service Provider informs the Client of the purposes of data collection, processing, and storage, as well as the software and techniques used. The Service Provider and any subcontractors undertake to collect and process personal data in compliance with applicable regulations.
The Service Provider must obtain the Client’s consent before processing their personal data. In the event of subcontracting, the contractual responsibility of the subcontractor is specified in the contract. In the event of a security breach affecting the Client’s personal data, the Client will be informed as soon as possible.
Personal data collected during the use of the Service is processed in accordance with IzyPet’s privacy policy. The Client has the right to access, correct, and delete their data.
14. Applicable Law and Jurisdiction
These T&Cs are governed by, interpreted, and applied in accordance with French law.
In the event of a dispute regarding the performance, termination, or conditions of these T&Cs, the Company and the Client will endeavor to resolve their dispute amicably.
Subject to applicable mandatory legal provisions, any dispute related to or arising from the validity, performance, interpretation, or formation of these T&Cs will first be referred to the Company for an amicable solution and, failing conciliation, to the exclusive jurisdiction of the courts of Limoges (France).
15. Amendments to the T&Cs
The Service Provider reserves the right to modify these T&Cs at any time. The changes will be notified to the Client, who may accept them or terminate their Subscription.
